1 :: Syrian Patent Law

A new Law has been issued in Syria regulating the Patents, Utility Models, Integrated Circuits and Layouts. The law No. 18/2012 dated March 30, 2012 came into force on June 1, 2012.
And hereunder are some of the most important new changes in the law:

    • Examination is possible as to 1st Novelty, 2nd Inventive Step and 3rd Industrial Applicability.
    • Accepted patent applications will be published in the Official Gazette for 6 Months.
    • Any interested 3rd party can file an opposition within the 6 Months period as from the publication date.
    • Term of protection for a Patent in Syria is 20 Years as from the Filing Date.
    • Annuity Fees are due annually as from the filing date. There is a 6 Months grace period for late payment of the annuity fees with a delay fine.
    • Reinstatement of a patent is possible within 6 Months from the date of cancellation of a patent.
    • A patent has to be worked. If the patent is not being fully exploited by the patentee within strong4 years from the date of filing or 3 years from the date of grant, the patent will be subject to compulsory licensing under the provisions of the law.

2 :: Overview of the Patent Regsitration Process

The patent regsitration process has 3 main stages in Syria as the following:

Stage 1 :: Filing & Examination

Time Frame: 3 – 6 Months

The application will go through the formalities and substantive examination.

Stage 2 :: Publication Stage

Time Frame: 6 Months

After acceptance of the patent application, it will proceed to publication once the publication fees been paid.

Stage 3 :: Registration Stage

If the publication period ended up without any opposition filed against the patent application, then the patent will be registered in Syria.

Registration Period: 20 Years from the Filing Date

..:: Patent Requirements ::..

1 :: National Patent Application

The required documents to apply for a National Patent Registration are as the follwoing:

  1. Power Of Attorney. Legalized from the Syrian Embassy.
    Late Filing is possible within 3 Months from the Date of Filing. Subject to Delay Fines.
  2. Priority Document. Certified [Singed and Sealed] from the Home Patent Office.
  3. Title of the Invention, Specifications, Claims, Abstract and Drawings. All in English with the Arabic translation. [3 Copies, each].
  4. Assignment from the Inventor(s) to the Applicant.

2 :: PCT International Application (National Phase Entry)

The required documents to apply for National Phase Entry of a PCT Application are as the follwoing:

  1. Power Of Attorney. Legalized from the Syrian Embassy.
    Late Filing is possible within 3 Months from the Date of Filing. Subject to Delay Fines.
    The procedure of getting the Security Approval and Super-Legalizing the Power of Attorney in Syria takes (1 – 2 Months); therefore, you should send it ASAP.
  2. Copy of the PCT International Application (Form 101).
  3. WIPO IB advice of receipt of priority document (Form 304).
  4. Copy of the PCT Publication.
  5. Copy of the Search Report and the ISA’s written opinion.
  6. Copy of the Preliminary Examination Report.
  7. Specifications, Claims, Abstract and Drawings. All in English with the Arabic translation. [3 Copies, each].

..:: Patent Annuity Payments ::..

1 :: Overview

The duration of the invention patent protection is: 20 Years starting from the Filing Date, Non-renewable.
In light of the above please note the follwoing:

  • An Annual Fee shall incur ,and increase gradually as from the beginning of the second year until the termination of the patent protection duration.
  • Late payment of the annuity fee is possible within 6 Months from the due date; however, late payment of the annuity fee will be subject to delay fine as the following:

    Annuity Fee + 50% of the Annuity Fee

  • If 2 Years elapsed without having a decision on the patent application, then the applicant can withhold the payment of the annual fee until the issuance of the grant decision, and it is possible to settle all the outstanding annual fees in one payment.

3 :: Annula Fees Payment Requirements

No documents required for pyament of the annuity fee. We need the application infromation only.
